Banking & Financial Disputes
If your insurer has refused to pay a claim on your insurance policy, or you've been mis-sold a financial product by a broker or financial adviser, we can help you seek redress. We support individuals with complaints to regulators like the Financial Ombudsman Service and issuing proceedings to recover losses when needed.
Review of contractual documentation
We’ll carefully review all relevant contracts and supporting documents to identify any alleged breaches. We work with you to gather and assess evidence, advise on your legal position, consider the extent of your losses, and evaluate the strength of your case.
Pre-action steps
We prepare clear and detailed pre-action letters, formally notifying your opponent of your intention to bring legal proceedings if an agreement can't be reached. We'll also consider the suitability of negotiation and settlement.
Drafting your claim
If your dispute can’t be resolved early, we’ll guide you through the court process. We’ll draft your legal claim clearly and thoroughly, setting out the key facts, the legal basis of your case and what remedy you’re seeking.
Evidence gathering
We help you collect the right evidence to support your claim. This might include reviewing pre-contract communications, requesting key documents from third parties, and drafting witness statements from relevant individuals.
Negotiation and settlement
Parties are encouraged to consider methods of alternative dispute resolution at all stages of a dispute. We’ll guide you through options for resolving your dispute outside of court. Whether through negotiation, mediation or another process, we’ll advise on the best route forward and make sure any settlement terms are clearly recorded.
Questions we’re often asked
Yes. The time limit depends on your chosen course of action. Complaints to the Financial Ombudsman Service must usually be made within six months of receiving a final response to your complaint. Court claims are generally subject to a six-year time limit from when the issue occurred.
You may still be able to bring a claim through the Financial Services Compensation Scheme.
We’ll work to recover losses with the aim to put you in the position you’d be in if there hadn’t been a breach of contract and/or a negligent act or omission.
