Questions we’re often asked

What should be included in Heads of Terms?

They should set out key terms such as parties, property details, term, rent, repair obligations, break options, renewal rights, permitted use, alterations, assignment, insurance obligations, service charge, and legal costs. Agreeing these early avoids misunderstandings later.

What’s the difference between a lease and a licence?

A lease gives exclusive possession of a property. A licence permits use without exclusive possession or tenancy rights.

Can I end a commercial lease early?

You usually need a break clause or agreement. Ending a commercial lease early without one can lead to costs (including having to pay the rent due for the remaining term and loss of rent deposits) and legal action for breach of contract. We can help you explore options like a Deed of Surrender.

What are my responsibilities for repairs?

Most commercial tenants take on a full repairing lease. That means the tenant is responsible for all repairs/maintenance and for keeping the property in good condition, regardless of the condition they took the property in (unless the lease is subject to a schedule of condition).
