Title Splits and Creation of New Leases

If you own a building with multiple flats that are all held under one freehold title, we can help you split the title and grant long leases for each flat. This gives each flat a separate legal identity, making your property easier to manage, sell, or refinance.

What is title splitting?

Title splitting is the process of dividing a single freehold title into long leasehold interests for each flat. It creates new legal titles for each unit, allowing them to be individually sold or refinanced. It also helps set clear terms around responsibility for maintenance, insurance and service charges.‍

Who benefits from title splitting?

Title splitting is ideal for landlords renting out multiple flats in one building, property investors looking to release equity on individual units, and developers preparing a multi-unit building for sale. It gives each flat a clear legal identity and boosts financial flexibility.‍

The reasons for considering title splitting

It gives you more options. You can sell flats separately, refinance them more easily, and improve clarity over management responsibilities. Leases define who’s responsible for what, which helps avoid disputes. As well as better management, service charge and maintenance obligations are clearer.‍

The steps we take

We review your title, draft leases tailored to your plans, advise on key provisions, coordinate compliant plans, liaise with lenders, and register leases to secure individual title numbers, giving you a clear and future ready structure.

Questions we’re often asked

How can you help?

We review your title, draft leases tailored to your plans, advise on key provisions, coordinate compliant plans, liaise with lenders, and register leases to secure individual title numbers, giving you a clear and future ready structure.

Can I keep the freehold?

Yes. You can retain the freehold and grant leases to each flat, or transfer it to a management company if preferred.

Will this affect my mortgage?

Possibly. We liaise with your lender to ensure the leases meet their requirements.

What are Land Registry compliant plans?

Detailed drawings that show the layout and boundaries of each flat. They are essential for registering new leases.

Can I grant a lease to myself?

No. You cannot grant a lease to yourself in law. You will need to grant the lease to a separate company or individual.

Will there be stamp duty land tax (SDLT) payable on the grant of a new lease?

Possibly, depending on who the new lease is being granted to. You should seek tax advice, in order to grant the leases in the most tax efficient way.
