It never ceases to surprise us the serious misconceptions that employers and employees often have about post-termination restrictions. In reality, when properly drafted, post-termination restrictions (also known as restrictive covenants) can be a very effective method of an employer protecting its interests after the departure of an employee who may have had access to the employer’s confidential information, contact with its clients and developed close relationships with other members of staff.
