Lasting Powers of Attorney
Whilst no one wants to think about losing mental capacity, it is an increasing problem for our ageing population. Blacks Solicitors’ expert Wills & Probate team can help give you peace of mind through advice on, and preparation of, Lasting Powers of Attorney (LPAs).
LPAs are essential planning documents so that if you did become mentally unwell, your chosen relatives or friends could make decisions on your behalf (regarding your property and financial affairs, or health and welfare), in the event that you are unable to.
There are numerous advantages of making an LPA including:
- Deciding who will make decisions on your behalf
- Guidance on how your Attorneys act
- The ability to appoint more than one Attorney and replacement Attorneys
- Legal peace of mind should you become unable to make decisions
Property and Financial Affairs Lasting Powers of Attorney
Attorneys appointed by a Property and Financial Affairs LPA can make decisions regarding your finances.
They will be able to look after your finances and even sell your house if you give them permission to do so. While you still have the ability to participate in those types of decisions, your Attorneys must consult you to find out your wishes.
If you can’t make your own decisions, then your Attorneys have the right to make decisions for you; but they must always act in your best interests.
Health and Welfare Lasting Powers of Attorney
This authorises your chosen Attorneys to make decisions regarding your health and welfare only if you have lost the ability to make such decisions yourself.
Common examples of the types of decisions made by Attorneys are where an individual resides, and whether medical treatment is to be given or refused.
It is also possible to authorise your Attorneys to consent to, or refuse, life-sustaining treatment on your behalf.
