Employer Disputes

Our team have experience in dealing with a wide range of matters involving restraint of trade, which includes: Post-Termination Restrictive Covenants (include solicitation of staff, customers, suppliers, working for a competitor in a restricted role, or for clients of the former employer); allegations of misuse of confidential information; and Intellectual Property infringement.

We can assist in all forms of employment disputes, including termination (and threats of termination), and allegations of breaches of employment contracts (written or unwritten), both during employment and post-termination.

Director/Shareholder Disputes (including Derivative Actions)

Majority shareholders might be accused by minority shareholders of actions that unfairly prejudice their interests. The Courts can correct the position by winding up the company, or requiring one side to buy out the other.

A ‘Derivative Action’ is a claim brought by a shareholder (member) of a company against its directors and/or other officers in the name of the company to seek redress for a breach of fiduciary duty, gross negligence, mis-management, or other serious matter.

Partnership Disputes

Disputes can arise within a partnership, even where the partners have previously enjoyed a good relationship. It may be about the conduct of the partners, the use of partnership resources, or other issues.
