Employing Overseas Nationals

Blacks Solicitors’ Immigration team in Leeds understand that hiring the right person for the job is central to any company’s success. Immigration is a complex and fast-changing area of law and businesses face ever increasing challenges when employing overseas nationals.

If you have identified an outstanding candidate to hire who doesn’t currently have permission to work in the UK, or a shortage of supply is causing you to actively recruit from abroad, you will need to understand what immigration routes might be available in any given situation.

Hiring EU Citizens

Currently all EU citizens have to register under the EU Settlement Scheme. Further information around the recruitment of EU nationals can be found here.

Hiring Non-EU citizens

There is a separate system in place if you would like to hire non-EU nationals.

Non-EU nationals require permission to come to the UK, traditionally in the form of a Visa (more specifically in the form of a Biometric Residence Permit). However, some migrants might have the right to work in the UK independent of any sponsorship by an employer.

For example, an individual might have the right to work on the basis of: a relationship with a British or EU national; as a Commonwealth citizen; on the basis of UK ancestry; as a student; or if the individual has obtained a right of Indefinite Leave to Remain, and will therefore be permitted to work in certain defined circumstances.

However, if the individual has no prior authority to work in the UK, then you will likely need to sponsor the individual under the Points-Based System.

In order to sponsor an individual you will first need to apply for a Sponsor Licence.
