Dealing with Suspensions & Revocations

Blacks Solicitors’ Immigration team in Leeds support clients in relation to Home Office investigations, and Sponsor Licence suspensions and revocations.

When an employer applies to become a sponsor it agrees to comply with the extensive duties and responsibilities which are attached to the Licence and employers are expected to be fully familiar with Home Office guidance.

The Home Office can decide to carry out an onsite, comprehensive examination of your systems and their visit may be announced or unannounced. Where the Home Office believes that you have failed to discharge your duties then you can face a range of sanctions.

Sanctions can include having your Sponsor Licence suspended or revoked, with the effect that any sponsored migrants could have their employment terminated and Visa/s revoked.

Sponsor Licence Support

Blacks’ Business Immigration team can help you to keep on top of your duties and avoid coming to the adverse attention of the Home Office. We can do this by:

  • Reviewing your systems and processes to make sure you are meeting/will meet your obligations
  • Helping you to prepare for a Home Office visit
  • Training HR staff on compliance issues
  • Ensuring your employment contracts are adequate in terms of immigration compliance

If you have received a letter from the Home Office threatening to take action against you we can help you by:

  • Making written representations to the Home Office on your behalf
  • Attending Home Office meetings with you

Mergers and Acquisitions

There are strict rules regarding sponsorship when it comes to complex corporate structures, mergers, and acquisitions.

Specific reporting duties are likely to arise and, as Licences are not transferrable, a new owner might need to apply for a new Licence. There are also specific sponsorship rules which relate to TUPE.
